TERMS AND CONDITIONS
Tony's Mobile Powerwashing & Detailing Terms of Service
Please thoroughly review the Terms and Conditions agreement before we commence work to understand our service expectations.
Acceptance to terms
By accepting the quotation/estimate with Tony's Mobile Powerwashing & Detailing the client agrees to all terms and conditions in this agreement and authorizes TMP to perform the service at an agreed upon price. This agreement is entered in between (Client) and (TMP) Tony's Mobile Powerwashing & Detailing Services. The above-mentioned parties hereby agree to the following terms.
Description of Binding Agreement
This document serves as a binding agreement between the homeowner, now identified as "client" and Tony's Mobile Powerwashing & Detailing Services identified as "TMP" and its owners, employees and subcontractors, now identified as "Company", for the execution of services in exchange for payment for residential or commercial outdoor cleaning including pressure washing and non-pressure washing. The services that TMP provide to you are subject to the following terms, and we reserve the right to update the terms and conditions anytime without notice. You can review the terms and conditions by clicking on the terms and conditions links via our website, email communications or any other communications such as quotes and invoices. TMP is committed to protecting the data collected pertaining to our users, and do not give out client information to third parties.
Authorization
Client agrees to allow TMP on the property for cleaning services. Client understands that the completion of service has no set timeframe and may require several visits to the property. In addition, the cleaning may need to move to the next available time if unforeseen circumstances like bad weather or personal emergency comes up. Client understands that the Company will do their best to accommodate an immediate reschedule but must work around other scheduled clients and weather. The Company also has permission to visit the property with little or notice to assess service needs before the service date and to check completion after services have been rendered.
Water usage
Client agrees to allow TMP to utilize their residential water source via an outdoor tap, which will be turned on and easily accessible on the service date. If on well water, or if in an area with low water pressure or volume, the client agrees to cease all water consumption inside the home, including faucets, dishwashers, washing machines, outdoor sprinkler systems etc.
Electric usage
Client agrees to provide TMP with the right to use an on-site source of electricity as needed to complete the stated project without compensation.
Acknowledgement of Risks and Releases of Liability
TMP's technicians are trained to use the equipment and cleaning products and take extreme precautions not to cause harm and damage to property. Safe techniques in cleaning will operate with the use of low-pressure cleaning to delicate surfaces such as sidings and roofs. However, damage can still occur due to poor maintenance, neglect of the property, or low-grade building materials. To avoid potential defects, the client should have routine maintenance following the manufacturer's recommendation. Before washing the home, the client must address any areas of concern to ensure a watertight seal to prevent damage. Client assumes all the risk and takes responsibility for any damage due to the above explanations. Client releases the Company of property damage unless negligence or willful misconduct caused it.
Plant/Landscaping
Client understands that TMP has a set of procedures to ensure the plant life around the area is kept clean and protected. In addition, the client understands that washing service may be scheduled during midday, and there could be potential for leaf burn as water could spray or get around plants during the cleaning process.
Oxidation
A house that has not been maintained or has contact with sun exposure may be susceptible to oxidation. Signs of oxidation are a chalky white powder on sidings. Client understands that oxidation and other blemishes will be noticeable after cleaning, especially in houses covered with debris.
Window Cleaning and Window Screens
Client understands that during the window cleaning process, only basic window cleaning is performed. A basic window cleaning will eliminate debris off the window. The client must understand that some window screens are susceptible to damage, delicate and brittle during window cleaning. There may be damages because of wear and tear which are the responsibility of the homeowner.
On The Day of Service
1. Please have a water spigot or outdoor tap activated and accessible.
2. During the House Wash and Window Cleaning, please have all windows & doors shut tightly.
3. Please have all pets inside before and during cleaning.
4. Please clear the work areas of all items and remove all flags, doormats, vehicles, or sensitive materials from the areas to be cleaned for work efficiency, to avoid damage and safety.
5. The Company suggests Client utilizes their property's safety switch or circuit breaker to shut-off power to any exterior outlets, light fixtures, or electrically powered features.
6. Client must understand that the Company strives to be as efficient as possible, so respect is expected of the client. Please understand that TMP will refuse to service any client conveying disrespect to any TMP team members.
Exclusions:

​There is a $50.00 cancellation fee if notice is not received within 48 hours of service.

If TMP arrives and cannot perform service due to steps 1-4 "On The Day Of Service" not being completed.

TMP is not responsible for water intrusion. While every effort is made, they will not be required to wait to perform service until steps are done. to prevent this, bad seals around windows and doors and cracks in concrete foundations can make this unavoidable.

TMP will do the job to the best possible result. This agreement to provide services is in no way a guarantee that it will remove stains completely.
Client is expected to notify the Company of any areas that cannot have any form of cleaning. If TMP doesn't receive notification before service is performed, TMP will not be responsible for any ill effects on any surface.
Media Release
The client agrees to allow TMP to use any photos, descriptions, reviews, quotes, or videos of the property or the client in the context of marketing or advertising. TMP will use the media for marketing and training purposes only. The client agrees not to seek punitive action in a civil court of law regarding the development, display, reproduction, or printing of the above examples of media. Including the use of photos, reviews and videos posted or displayed on online venues such as social media and the Company's website.
Payment
Payment is due upon receipt. Payment will be in the form of Cash or Certified Check payable to the Company.
If any damages occurs
TMP is obligated under these terms and conditions for any damage resulting from negligence, willful misconduct and operator error. Discovered damage must be reported within 48 hours of service completion. The Company will be allowed 30 calendar days from the date of notification to inspect the premises and have the sole option of repairing or contracting repairs to any damages resulting from negligence.
Detailing Vehicles Section
Prior to arrival all personal property should be removed from client's vehicle. The compartments containing personal belonging will not be cleared or emptied by TMP's detail team.
Service Time of Vehicles
Service times are only an estimate. Each vehicle is different and may require more or less time to fulfill the service.
Inclement Weather Cancellation Policy
TMP can never exactly predict what the weather will be. Please remember every scheduled service appointment is weather permitting.
On-Site Service Policy
TMP is able to bring services to client as this is the goal. Client must have a site such as their home or office and have permission to perform services there. TMP cannot work on vehicles parked on the streets as this is illegal in some cities and the safety of our team could be compromised.
Release of Liability
This agreement for services is entered into between Client and TMP
From here on Client will be referred as "I"
The above-mentioned parties hereby agree to the following terms
Damage to Vehicle
I, hereby agree that TMP shall not be held liable for any mechanical conditions or pre-existing condition such as dents, scratches and any other pre-existing damages to the vehicle's interior/exterior or for the loss or damage of articles/belonging left in vehicle due to a fire, theft, accident, service provided or any other cause by TMP, control. It is my responsibility to point out items that are fragile or no longer functional where in many cases the damage is not noticeable due to the state of vehicle prior to detailing. I agree that I am responsible to go over my vehicle with TMP affiliate member, staff or representative before they leave. I hereby agree and certify that any claim or equitable claim that may arise from participation in the above shall be resolved under New York Law. In the event of legal action be necessary I agree to pay the attorney's fees and court costs. I have fully read this document Tony's Mobile Powerwashing & Detailing Services Terms & Conditions and fully understand that by making an appointment by phone or in person or online. I voluntarily surrender and discharge TMP and affiliates, members, staff, and representatives from all claims or causes of any right that I otherwise would have to bring a legal action against TMP for personal injury or property damages.
